Terms of Service
The deal, in plain language.
The short version
- You give us a video; we give you back finished clips. You own your footage and the clips we make from it.
- You may only upload footage you have the right to use, and nothing illegal.
- Subscriptions renew until you cancel. You can cancel any time and keep access until the period ends. Refunds are described on the refunds page.
- The clips are made by software. They are usually good and sometimes wrong. Check before you post.
- Swedish law applies. If you are a consumer, nothing here takes away rights the law gives you.
1. Who we are
GambitClip is operated by [COMPANY LEGAL NAME], organisation number [ORG NUMBER], [STREET ADDRESS, POSTCODE, CITY], Sweden. Contact: hello@gambitclip.com.
2. The service
GambitClip takes a long video (a stream recording, a gameplay session, a podcast) and returns short vertical clips: chosen, cut, captioned, framed, titled and scored by our software. We may change, improve or discontinue features as the service develops; if we discontinue a paid feature you rely on, we will tell you in advance and refund what you have paid for and cannot use.
3. Your account
You must be at least 16 to use GambitClip and 18 to buy a subscription (a parent or guardian can buy it for you). Keep your sign-in secure; you are responsible for what happens under your account. Tell us at once if you think someone else is using it.
4. Your footage and your clips
You keep everything you own. Uploading footage does not transfer any rights to us. You grant us only the licence we need to process the footage and deliver the clips to you: to store it, analyse it, cut it, caption it and show it back to you, using the service providers listed in our Privacy Policy. That licence ends when the footage is discarded at the end of the run and the clips are deleted, which happens automatically 30 days after a run unless you delete them sooner. Download what you want to keep.
The clips we make from your footage are yours to post, edit and monetise as you like. Captions, titles and scores are generated by software from your content; you may use them freely.
You promise that you have the right to upload the footage and to have it processed this way, including any rights of the people who appear or speak in it. You are responsible for what you post afterwards and for complying with the rules of the platforms you post to.
5. Posting to other platforms
You can connect your own YouTube, TikTok, Instagram or X account and have GambitClip post clips to it. We post only on your instruction: when you click Post, at a time you schedule, or automatically for a recording you processed with automatic posting switched on. You choose the platforms, and you can disconnect any of them at any time.
What you post is yours and your responsibility, including the title and description, which we pre-fill and you can change. Each platform applies its own rules, limits and fees to your account; we pass on their limits (for example a daily number of posts) and their decisions (for example a rejected upload) as they reach us, and we are not responsible for them. Some platforms restrict what new apps like ours can do until they have reviewed us; the app tells you when a post will be private or delayed for that reason.
6. What you may not do
- Upload footage you do not have the right to use, or that infringes anyone's copyright, privacy or other rights.
- Upload material that is illegal, or that depicts sexual abuse, promotes violence or hatred, or harasses a person.
- Use the service to make clips intended to deceive, defame or harm someone.
- Attempt to break, overload, reverse-engineer or scrape the service, or to use it through anything other than the app and site we provide.
- Share your account or resell the service.
- Use the service from, or on behalf of anyone in, a country under comprehensive EU or United States sanctions, or if you are on a sanctions list.
Our Rules spell these out with examples of what is and is not allowed. We may remove content, suspend or close accounts that break them, and we will refund unused paid time unless the breach is serious. You can appeal any decision within 30 days through the report page; a person who was not involved in the first decision reviews it.
7. Plans, credits and payment
GambitClip is sold as a free tier and paid subscriptions measured in minutes of video processed. Each plan states the minutes it includes and any limits. A run costs the length of the video rounded up to the whole minute, consumed when the run starts; if a run fails on our side, the minutes are returned automatically. At each renewal your minutes reset to your plan's allowance, and on the free tier at the start of each calendar month; unused minutes do not roll over. Minutes are a licence to use the service: they have no cash value and cannot be transferred or exchanged for money, except where this page or the law says you get a refund.
Subscriptions are billed in advance and renew automatically at the end of each period until you cancel. The total you will pay, including any tax, is shown before you confirm. Payments are processed by Stripe under their terms. If a payment fails we will retry and tell you; if it keeps failing, your plan drops to the free tier.
You can cancel any time from your account. Cancelling stops the next renewal; you keep your plan until the current period ends. What you can get back is described on the refunds page, which forms part of these terms.
Taxes. Prices are shown in US dollars, or in your local currency where we offer it, and exclude VAT, sales tax and similar taxes unless the pricing page says otherwise. The tax for your country or state is calculated at checkout from your billing address and any tax registration number you give us, and the total is shown before you pay. Businesses in the EU that enter a valid VAT number are charged under the reverse-charge rules. You are responsible for the taxes on your purchase, other than taxes on our income, and for keeping your billing details accurate.
We may change prices. We will tell you at least 30 days before a change affects you, and you can cancel before it does.
8. Fourteen days to change your mind
Wherever you live, you can get back what you have not used within 14 days of a purchase, as set out on the refunds page. For consumers in the EU, the EEA and the UK this is also the statutory right to withdraw from a purchase made online. GambitClip is a digital service that starts delivering the moment you process a video. By starting a run within the 14 days you ask us to begin immediately and you acknowledge that you lose the right of withdrawal for the minutes you use. Minutes you have not used remain refundable within the 14 days.
9. What the software can and cannot promise
The clips are chosen and cut by software, using AI models. We work hard on quality and we are honest about it: every clip comes with a score, and the score is an estimate. The software will sometimes pick the wrong moment, cut at the wrong place, mis-hear a word or write a title that misses the point. Review clips before you post them. We provide the service as it is and as available. We do not promise that any clip will perform in any way on any platform.
10. Beta features
GambitClip is new. Features marked beta, preview or early access may change, break or disappear without notice, and are not covered by any promise of availability. Using them is your choice, and we want to hear what you think of them.
11. Availability
We aim to keep the service running but do not promise uninterrupted availability. Processing times depend on the length of your video and on our providers. If we are down for a significant time we will extend paid periods accordingly.
12. Our rights
The service, its software, design, name and logo belong to us and our licensors. These terms do not give you any right to them beyond using the service as intended. We own the technical data about how the service runs (timings, error reports, usage counts); it never includes your footage, and we use it only to run and improve the service. If you send us feedback or ideas, we may use them freely without owing you anything.
13. Liability
If someone brings a claim against us because of footage you uploaded without the right to, or because of how you used the service or the clips in breach of these terms, you agree to cover the reasonable costs and damages that claim causes us, to the extent the law allows. This does not apply where the claim results from our own fault.
To the extent the law allows, we are not liable for indirect losses such as lost revenue, lost followers or lost data caused by the service, and our total liability for any claim is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for intent, gross negligence, or the mandatory rights of consumers under Swedish and EU law.
14. Ending the agreement
You can close your account at any time from your account settings; your data is then deleted as described in the Privacy Policy. We can end the agreement with 30 days' notice, or immediately if you seriously breach these terms. When the agreement ends, your access ends with it; download your clips first. Sections that by their nature should survive (your ownership of your clips, our rights, liability, law and disputes) keep applying.
15. Changes to these terms
We may update these terms. For changes that affect you materially we will tell you by email or in the app at least 30 days in advance; if you do not agree, you can cancel before they take effect. Continuing to use the service after that date means you accept the new terms.
16. Copyright and illegal content
Our Copyright Policy says how to send us a copyright notice, how an account holder disputes one, and that we close the accounts of repeat infringers; it applies to notices under the United States Digital Millennium Copyright Act and the EU Digital Services Act alike. To report content you believe is illegal or against our Rules, use the report page. For the EU Digital Services Act, our single point of contact for users and authorities is hello@gambitclip.com, in English or Swedish.
17. Law and disputes
These terms are governed by Swedish law, and disputes are settled by Swedish courts. If you are a consumer, you keep the mandatory protections of the country or state you live in, and you may bring a claim in its courts; nothing here limits your rights under, for example, your state's consumer protection laws in the United States. If you are a consumer in the EU, you may also turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN, Box 174, 101 23 Stockholm), or to the equivalent alternative dispute resolution body in your own EU country. We will take part in ARN proceedings.
18. The small print
Notices. We send legal notices to the email address on your account, and you send them to hello@gambitclip.com. Keep your address current; a notice sent to the address on file counts as delivered.
Assignment. You may not transfer this agreement to someone else. We may transfer it to a company that takes over the service, and we will tell you if we do.
Waiver and severability. If we do not enforce a term today, we may still enforce it later. If a court finds a term unenforceable, the rest of the terms stay in force and the term is read as narrowly as needed to make it valid.
Entire agreement. These terms, the Rules, the Refund Policy, the Privacy Policy, the Copyright Policy, the Cookie page and, for organisations, the Data Processing Agreement are the whole agreement between you and us about the service, and they replace anything said earlier. If this page and the Data Processing Agreement conflict on data protection, the DPA wins.
